However, AlertSite uses a subscription form for you to request services. In connection with this subscription form, AlertSite collects your contact information, such as name, address and phone number, e-mail address and financial information, such as account or credit card numbers. Information collected from the subscription form is used to send orders, billing materials, and information about AlertSite. This information is also used to contact you when necessary in connection with our services. Financial information that is collected is used strictly for internal purposes only. AlertSite will not disclose, sell or give rights to any personally identifiable information from you to any third-party in ways other than disclosed in this policy.

Some of the information AlertSite receives about you or your visit to www.AlertSite.com may be used for our internal research and to help us to improve the site and the services AlertSite offers to its customers. In general, the Internet addresses of computers, also known as IP addresses, are logged to track user sessions on an anonymous basis. Service Providers

We use other third parties to provide enhanced notification services and member credit card processing on our site. When you sign up for any of these services, we will share information as necessary for the third party to provide that specific service. In the case of our enhanced notification services such as phone alerts, paging and SMS services, our third party provider is supplied with the telephone number and message the user has requested to be sent. Our third party credit card processor is provided with the card information necessary to process payment for services we submit and our user authorizes.

These third parties are prohibited from using your personally identifiable information for any other purpose.

Choice/Opt-out (Evaluation Period)

AlertSite sends weekly promotional communications to users who have signed up for our 30-day trial evaluation during the evaluation period that contain the users monitoring results to date and additional information regarding AlertSite's products and services. At the end of the 30-day evaluation period, two follow up promotional e-mails strictly containing information about AlertSite's products and services are sent (one the week after the 30-day expiration and the second thirty days later). Consequently, these communications will end no later than sixty days following the beginning of the evaluation.

In addition to the evaluation period communications, users also receive an order confirmation e-mail along with a security verification e-mail immediately following registration.

Users are not given the choice to opt-out of receiving the communications described above since they are requirements of registering for a free evaluation of our services.

Choice/Opt-out (Other)

Our users are given the opportunity to opt-out of having their information used for purposes not directly related to our site at the point where we ask for information. For example, our order form has an opt-out mechanism so users who buy a service from us, but don't want any marketing material such as information about upgrades, discounts or special promotions, can keep their e-mail address off of our lists. For any non-service related communications or information uses, our opt-out mechanism defaults to the opted-in status until users explicitly opt-out for the first time.

Users who no longer wish to receive our newsletter and promotional communications may opt-out of receiving these communications by e-mailing us at customercare@alertsite.com or by contacting us by telephone or postal mail at the contact listed below.

Access to Personally Identifiable Information

A user may access their personally identifiable information through a secure login provided on our Web site.

If your personally identifiable information changes, you may correct or update it by making the change directly through your manage account control panel. If you should no longer desire our services, you may delete or deactivate your personally identifiable information by e-mailing our Customer Support at support@alertsite.com or by contacting us by telephone or postal mail at the contact listed below.

Customer Forum

If you use the customer forum on this site, you should be aware that any personally identifiable information you submit there can be read, collected, or used by other users of this forum, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit in this forum.

Customer Testimonials

We post customer testimonials on our Web site which may contain personally identifiable information such as the customer's name. We do obtain the customer's consent, prior to posting the testimonial, to include any personally identifiable information along with the testimonial.

Governing Law and Jurisdiction

This Privacy Policy is to governed and construed in accordance with the internal laws of the State of Florida, without regard for principles of conflicts of laws.

Any civil action, claim, dispute or proceeding arising out of or relating to this Privacy Policy shall be referred to final and binding arbitration, before a single arbitrator, under the commercial arbitration rules of the American Arbitration Association in Palm Beach County, Florida.

The arbitrator shall be selected by the parties, and if the parties are unable to reach agreement on selection of the arbitrator within thirty (30) days after the notice of arbitration is served, then the arbitrator shall be selected by the American Arbitration Association.

Judgment upon any award rendered by the arbitrator shall be final, binding and conclusive upon the parties and their respective administrators, executors, legal representatives, successors and assigns, and may be entered in any court of competent jurisdiction. Notwithstanding the previous sentence, in no event shall any party be entitled to punitive damages and all parties hereby waive their rights to any punitive, special, indirect or consequential damages, including, but not limited to, damages for any loss of profit, revenue or business.

If any portion of this Privacy Policy is deemed unlawful, void or unenforceable by any arbitrator or court of competent jurisdiction, this Privacy Policy as a whole shall not be deemed unlawful, void or unenforceable, but only that portion of this Privacy Policy that is unlawful, void or unenforceable shall be stricken from this Privacy Policy.
